So you have bailed someone out of jail using a bail bond agent. And now that person misses their court date. So what happens now, and who is responsible? The answer is the same whether we are talking about Arizona bail bonds, Michigan bail bonds or anywhere in between.
Usually when this happens it is a simple mistake or misunderstanding. This is the real world, and we all realize that things can happen. It could be car trouble, or maybe the defendant was just sick. Courts recognize this, so if that is the case, it is really not a big deal. This usually just takes a simple phone call to the defendant to ask what happened. Then a new court date is scheduled.
On the other hand, sometimes defendants run away from the problem. In this case you are dealing with forfeiture. Ultimately, since you signed for the defendant, you would be responsible. So let’s say that bail was set at $10,000. You already paid $1000 to the bail bond agency. That was just a premium, so you would still owe the bail bond agency $10,000 in this example. Depending on the contract that you signed, you may also be responsible for other restitution including paying for a recovery agent (bounty hunter).
